A South Australian teenager who took photos of his genitals and sent them to his girlfriend — who after their break-up posted one on social media — has been spared a conviction for producing child exploitation material. The year-old boy, who cannot be identified, pleaded guilty to two counts of producing child exploitation material over the pictures he took in September last year and sent to his then girlfriend. The boy's lawyer told the court the boy was apologetic when he was spoken to by police and made full admissions, telling them: "I've learnt my lesson and will never do it again. Youth Court Judge Penelope Eldridge said it was concerning to see so many of the cases before the court, and said the girlfriend had also played a significant role. Judge Eldridge told the boy that, nevertheless, he should not have taken the photos and it was "inappropriate" behaviour. The prosecution conceded the case was at the lower end of the scale of seriousness for that type of offending and the judge said she was prepared to exercise her discretion not to record a conviction.

Court of Appeals for the Fourth District ruled Tuesday that David Abbot, a former detective with the Manassas City Police Department, should have known that the search — would included ordering the teen to pull down his pants and masturbate in front of Abbot and two other detectives — was unreasonable. The teen at the center of the case, Trey Sims, was charged with possessing child pornography after police said he sent sexually explicit photos of himself to his year-old girlfriend.
Law enforcement officials in Manassas, Va. Their first subject could be year-old Manassas City resident Trey Simms, who faces two felony charges for allegedly sexting his year-old girlfriend. Prosecutors intend to prove Simms's guilt by forcing him to provide police with photos of his erect penis, for which a judge actually granted a search warrant! Simms's attorney, Jessica Harbeson Foster, told the Washington Post that Assistant Commonwealth Attorney Claiborne Richardson presented the defense with two options: the teen could either plead guilty or be forced to provide illicit photos of his genitalia.
